To those familiar with the development of western democracy in recent times, it is no secret that Poland has undergone a series of changes which have pushed back democratic reforms. According to the law scholar, former I. Michael Heyman Professor and constitutional expert, Sujit Choudhry, director of the Center for Constitutional Transitions, ever since the end of the Cold War the difficulties facing Poland have changed markedly. One of the big changes which Sujit fingers as a problem for those seeking to advance democratic policies and reform include the political organization known as the PIS (the Poland Law and Justice Party), a right-wing party which rose to considerable prominence in the polish government in 2015. The PIS were so successful that they won the majority of the legislature in the Sejm (the parliament).
Choudhry is one record as stating that the PIS are one of the foremost opponents to democracy through their take-over of the court system. Choudhry also notes in his study that the PIS are highly organized and quite patient, as their year-long undermining of the Polish parliamentary system aptly demonstrates. The changes represented by the PIS are, however, far more widespread and wide ranging and are not, by any means, exclusive to the part itself, but rather is part of a general trend towards authoritarianism and defensive nationalism. Indeed, in Poland, this trend has become so widespread and popular that political scientists and observers have created a name for it, autogolpe, which means, self coup or self revolt.
Choudhry has a long history with what he and many other constitutional scholars have termed the “authoritarian backsliding” of Poland and various other countries in Europe including, Hungary. For instance, in late 2017, Choudhry convened a political panel discussion designed specifically to address this question. Whilst the problem, not just for Poland, but for all of its neighboring countries, is substantial, Choudhry believes firmly that an increase in the education of constitutional history and reforms will, given time, move the country forward in a more positive and democratically constructive direction. Choudhry holds degrees from the University of Toronto, Oxford University and Harvard University. He taught political law at the University of Toronto as well as New York University.
